1. That the Tender No. ICT- 55/2020, the Dhaka Electricity Supply PLC (DESCO) and National Development Engineers Ltd. (NDE) entered into a contract vide Contract No. 27.24.0000.021.07.055.20.695, Dated: 03/06/2021 for construction of 12 (Twelve) storied commercial building with 06 (Six) nos. basement floors for 'DESCO Head Office at plot-49/A, Nikunja-2, Khilkhet, Dhaka' (Tender No: ICT-55/2020), Package Name: Total Civil Finish Works, Building Electro-Mechanical System and Complete Façade Works for DESCO Head Office Building. Due to the failure to fulfill the obligations as per the contract The DESCO Board in its Board Directors Meeting No. 496, dated: 02.01.2025 has decided to terminate the expired contract for the breaches of terms and conditions of contract and according to the same DESCO has issued a Notice of Default as per GCC clause 95.1(b)(iv) of the contract vide memo no. 27.24.0000.090.14.003.25.014 on 03.03.2025 and NDE replied the same without following the terms and conditions of the contract on 06.04.2025 vide memo No. NDE/IMP/DESCO/2025/1950. DESCO examined the reply of the NDE and found it quite unsatisfactory, unjustifiable, misleading and fictitious. Also, the contractor NDE failed to comply the contractual obligations and the reply of the NDE dated: 06.04.2025 did not fulfill the terms and conditions of the contract. Therefore on 12.05.2025 DESCO has terminated the Contract as per GCC Clause 95.1 of the contract.
That Pursuant to the GCC Clause 95.1(d) of the said Contract The NDE has been debarred for 02 (Two) years from the date of issuing of this letter. |
